General Terms of Use

General

These General Terms of Use ("Terms") govern the use of Kokit Application services ("Service"). By registering for the Service or using it, the User agrees to these Terms. If the User does not accept these Terms, they must not use the Service.

Kokit provides a platform ("Service") through which users ("User") can order food from partner businesses ("Partner") and have it delivered by transportation partners ("Delivery Partner"). Kokit acts as an intermediary connecting Users, Partners, and Delivery Partners but does not itself prepare or deliver food.

The User agrees to use the Service for lawful purposes, to adhere to good practices, and to comply with these Terms.

Definitions

Partner – Refers to a business entity that has signed a partnership agreement with Kokit and offers its products through the platform. All Partners are considered independent business operators.

Delivery Partner – Refers to an entity or individual that has signed a partnership agreement with Kokit and provides delivery services through the platform.

User – Refers to a natural person or a legal entity using the Service.

User Account

To use the Service, the User must register and create a personal user account. During registration, the User must provide accurate and up-to-date information. The User is responsible for maintaining the security of their account and all activities conducted through it.

The User must immediately notify customer service of any security breaches or unauthorized use of their account.

Payments

The User agrees to pay the total amount specified in their order using the payment methods available in the Service. Kokit collects payments on behalf of the Partners. The User’s payment obligation is established at the moment the order is placed.

Payments can only be made using the electronic payment methods available in the Service. Once the User has paid for the order through the platform, their obligation to the Partner is considered fulfilled.

If the Service supports meal benefit cards, the User may use their employer-provided meal benefit to pay for orders. The User is responsible for ensuring that their meal benefit payment does not exceed the allowed daily limit. If the total order amount exceeds this limit, the User must cover the excess using another payment method.

Payments are automatically charged from the User’s selected payment method upon delivery or pickup. Kokit reserves the right to place an authorization hold on the User’s payment method on behalf of the Partner at the time the order is placed.

If the User adds items that are priced by weight, the price shown in the Service is an estimate provided by the Partner. The final price is determined by the Partner based on the actual weight of the delivered product and is charged accordingly.

Any unused portion of an authorization hold is automatically refunded after the final charge is processed.

Kokit does not accept orders via email or chat. All payments must be made through the Service unless an explicitly stated alternative is provided in the platform.

Use of the Service

Kokit provides a technology platform that connects Users, Partners, and Delivery Partners. The Service enables Users to purchase meals and delivery services from selected Partners. Kokit does not prepare food or provide delivery services; it only serves as an order and payment platform.

Through the application, Users can browse meal options and products offered by Partners, place orders, and make payments using the available payment methods. Unless otherwise stated, all prices include value-added tax (VAT).

Partners are responsible for the accuracy of the information displayed in the Service, including menus, prices, and product availability. The applicable service and delivery fees are displayed in the application.

If the User has allergies or dietary restrictions, they must contact the relevant Partner directly before placing an order. Partners are obligated to provide allergy and product-specific information in compliance with applicable laws.

If an ordered product is unavailable, the Partner may substitute it with a similar product if the User has given prior consent. The substitute product will be as close as possible in quantity, quality, and price to the original product. No additional cost will be charged for the substitute item, and if the substitute is lower in price, the difference will be refunded.

If the Partner is unable to provide the ordered product, another Partner may fulfill the order, provided it meets similar quality and pricing standards. If a substitute cannot be provided, the User will receive a full refund.

Once an order is placed in the Service, it becomes a binding agreement between the User and the selected Partner. Orders cannot be canceled after the Partner has confirmed them. Kokit acts solely as an intermediary and is not a party to the contract between the User and the Partner.

After delivery, a receipt for the purchase will be sent to the User’s registered email address by Kokit or the Partner.

Delivery and Estimated Time

Orders are delivered to the location and street address confirmed by the User in the Service. The User must be present at the confirmed location during the agreed delivery time.

Delivery times are estimates only. Neither Kokit, the Partner, nor the Delivery Partner guarantees that the order will be delivered or ready for pickup at the estimated time. Delivery times may be affected by traffic, congestion, and weather conditions.

The User is responsible for ensuring the delivery address is accurate and detailed enough for successful delivery.

The User must be reachable via the phone number provided in the Service at the time of delivery. If the User cannot be reached, Kokit or the Partner may cancel the delivery, and the User will still be charged the full order price.

If the User is not available within five minutes of the delivery arrival and does not answer two call attempts, the order may be canceled, and the full amount will be charged.

Once the products are delivered to the specified location, the risk of loss or damage transfers to the User. Kokit and its Partners are not liable for damages occurring after delivery. If the User fails to collect the order, no refunds will be issued.
